2. Kdy tyto zásady platí

Tyto zásady se vztahují na zpracování osobních údajů při používání webu www.luxuryhumidors.eu, při objednávce a jejím plnění, při komunikaci s námi a při používání cookies a obdobných technologií.

3. Jaké osobní údaje zpracováváme

Zpracováváme zejména tyto kategorie údajů (podle toho, jak web používáte):

·       Údaje o zákaznickém účtu (pokud si ho vytvoříte): přihlašovací údaje a nastavení účtu.

·       Komunikace: obsah zpráv a požadavků zaslaných na zákaznickou podporu.

·       Technické a online identifikátory: IP adresa, identifikátory zařízení a prohlížeče, cookies a obdobné identifikátory.

·       Údaje o používání webu: informace o tom, jak se na webu pohybujete (např. navštívené stránky, zdroje návštěvnosti, události).

4. Odkud údaje získáváme

Osobní údaje získáváme:

·       Přímo od vás (při objednávce, registraci účtu, komunikaci, přihlášení k odběru e-mailů).

·       Automaticky při používání webu (cookies a podobné technologie).

·       Od poskytovatelů služeb, kteří nám pomáhají provozovat e-shop (Shopify a aplikace, platby, doprava, analytika a reklama).

5. Proč údaje zpracováváme a na jakém právním základě

Údaje zpracováváme pro tyto účely:

A) Plnění smlouvy (čl. 6 odst. 1 písm. b) GDPR

·       zpracování objednávky, doručení zboží, vyřízení vrácení a reklamací

·       komunikace k objednávce (potvrzení, změny stavu, doručení)

·       zřízení a správa zákaznického účtu (pokud si ho vytvoříte)

B) Plnění právních povinností (čl. 6 odst. 1 písm. c) GDPR

·       účetnictví a daňové povinnosti (faktury, účetní doklady)

·       vyřizování zákonných práv spotřebitelů

C) Oprávněný zájem správce (čl. 6 odst. 1 písm. f) GDPR

·       zajištění bezpečnosti webu a IT systémů, prevence podvodů a zneužití

·       základní statistiky a zlepšování fungování e-shopu (v rozsahu, který nevyžaduje souhlas pro cookies)

·       obhajoba právních nároků a řešení sporů

D) Souhlas (čl. 6 odst. 1 písm. a) GDPR

·       zasílání marketingových e-mailů (Shopify Email), pokud udělíte souhlas; souhlas lze kdykoli odvolat odhlášením v e-mailu

·       analytické a marketingové cookies a technologie pro měření a cílení reklamy (např. Google Analytics 4, Google Ads, Meta Pixel) – pouze po udělení souhlasu v cookie liště

6. Komu údaje předáváme (příjemci a zpracovatelé)

Údaje předáváme jen v nezbytném rozsahu, zejména těmto kategoriím příjemců:

·       Shopify (platforma pro provoz e-shopu a hosting) a případné aplikace v prostředí Shopify (zpracovatelé).

·       Platební poskytovatelé (např. Shopify Payments a metody dostupné v checkoutu) pro zpracování plateb.

·       Dopravci a logističtí partneři pro doručení objednávek v EU (např. Česká pošta a spolupracující dopravci podle země doručení).

·       Poskytovatelé e-mailingu pro marketingová sdělení (Shopify Email).

·       Poskytovatelé analytiky a reklamy (např. Google Analytics 4, Google Ads, Meta) – pouze v rozsahu dle vašeho nastavení souhlasů.

·       Poskytovatelé IT a bezpečnostních služeb (správa systému, zálohy, bezpečnost).

·       Orgány veřejné moci, pokud nám to ukládá zákon.

Poznámka k Shopify: některé rozšířené funkce Shopify mohou znamenat, že Shopify zpracovává určité údaje také jako samostatný správce (např. pro zlepšování svých služeb). Podrobnosti najdete v zásadách ochrany soukromí Shopify (privacy.shopify.com).

7. Předávání mimo EU/EHP

Protože používáme globální poskytovatele (zejména Shopify a reklamní/analytické platformy), mohou být některé údaje předávány mimo Evropský hospodářský prostor. V takových případech používáme uznávané mechanismy předávání, zejména standardní smluvní doložky (SCC), případně jiné mechanismy dle platných právních předpisů.

8. Jak dlouho údaje uchováváme (retenční doby)

Doby uchování nastavujeme tak, aby odpovídaly účelu zpracování a zákonným povinnostem. Typicky:

·       Objednávky, faktury a účetní doklady: obvykle 10 let (dle účetních a daňových předpisů).

·       Komunikace a zákaznická podpora: zpravidla 3 roky od vyřízení požadavku (nebo déle, pokud probíhá spor).

·       Reklamace a související dokumentace: po dobu uplatnění práv a dále po dobu běhu promlčecích lhůt (typicky 3–4 roky).

·       Zákaznický účet: po dobu jeho existence; po zrušení účtu údaje smažeme/omezíme, pokud je nepotřebujeme z právních důvodů.

·       Marketingový e-mailing (Shopify Email): do odvolání souhlasu nebo do doby, kdy zanikne účel (např. dlouhodobá neaktivita).

·       Technické logy a bezpečnostní záznamy: obvykle týdny až měsíce (typicky do 6 měsíců).

9. Cookies a podobné technologie

Používáme cookies a podobné technologie. Nezbytné cookies jsou potřebné pro fungování e-shopu. Analytické a marketingové cookies (např. GA4, Google Ads, Meta Pixel) používáme pouze po udělení souhlasu v cookie liště. Souhlas můžete kdykoli změnit nebo odvolat prostřednictvím nastavení cookies na webu.

Na webu používáme vestavěný nástroj Shopify Customer Privacy (souhlasová lišta). Ten řídí, které kategorie cookies jsou povoleny.

10. Vaše práva

V souladu s GDPR máte zejména tato práva:

·       Právo na přístup k osobním údajům (kopie a informace).

·       Právo na opravu nepřesných údajů.

·       Právo na výmaz (pokud jsou splněny podmínky).

·       Právo na omezení zpracování.

·       Právo vznést námitku proti zpracování založenému na oprávněném zájmu.

·       Právo na přenositelnost údajů (v zákonném rozsahu).

·       Právo odvolat souhlas kdykoli (u zpracování na základě souhlasu); odvolání nemá vliv na zpracování před odvoláním.

·       Complaints/returns documentation: during the exercise of rights and then for limitation periods (typically 3–4 years).

·       Customer account: for as long as the account exists; after deletion, we delete/restrict data unless we need it for legal reasons.

·       Marketing e‑mails (Shopify Email): until consent is withdrawn or the purpose ends (e.g., long‑term inactivity).

·       Technical and security logs: usually weeks to months (typically up to 6 months).

We use cookies and similar technologies. Necessary cookies are required for the e‑shop to function. Analytics and marketing cookies (e.g., GA4, Google Ads, Meta Pixel) are used only after you provide consent via the cookie banner.
