TERMS AND CONDITIONS FOR SALES IN THE EU
Luxury Humidors on the domain www.luxuryhumidors.eu (the “E‑shop”).
Effective from 22 Feb 2026.
For the purposes of these Terms, “EU” means the Member States of the European Union applicable on the date the order is placed. The E‑shop is intended for delivery within the EU. The Seller generally does not accept orders with a delivery address outside the EU; if such an order occurs (e.g., by mistake), the Seller may refuse or cancel it and refund received payments without undue delay. If the Buyer provides a delivery address outside the EU or later requests delivery outside the EU, the Seller is entitled to refuse the order and/or withdraw from an already concluded Contract. In such case, the Seller will refund received payments without undue delay.

These Terms govern the rights and obligations of the Seller and the Buyer (consumer). The sales contract is concluded at a distance via the E‑shop. The version effective at the moment the order is placed applies to the given order.
2. Definitions
“Buyer” = consumer (a natural person acting outside their trade or profession).
“Goods” = humidors and related accessories offered in the E‑shop.
“Gift voucher” = an electronic code with a nominal value that can be used as a discount against the purchase price in the E‑shop; the rules are set out in Article 7 Gift Vouchers.
“Contract” = a distance sales contract concluded via the E‑shop.
“Made to order” = Goods are ordered from the manufacturer/supplier only after availability is confirmed and after payment is received.
The E‑shop is intended exclusively for consumers (B2C). The Seller does not conclude purchase contracts with traders/businesses (B2B) through the E‑shop.
If a legal entity or a trader (self‑employed individual) wishes to purchase, they may send a request to info@luxuryhumidors.eu. Such request is assessed individually; if the Seller allows the purchase, it will be concluded at consumer prices and under these Terms (i.e., without individual wholesale terms). The trader acknowledges that provisions intended exclusively for consumers may not apply to such purchase even if made at consumer prices.
3. Information about Goods, prices and currency
Information about the Goods is shown on each product page. The presentation of Goods is for information only and does not constitute a binding offer. Consumer prices are stated including VAT. VAT may vary depending on the delivery country (OSS). The final price is always shown in the cart before the order is placed. For customers in the Czech Republic, prices must also be stated in CZK; an indicative price in EUR may also be displayed. Discount codes, gift vouchers and promotions are governed by the rules shown in the E‑shop; unless stated otherwise, discounts cannot be combined.
4. Order and Contract formation
The Buyer places an order via the cart and checks the details before submitting.
The automatic confirmation of receipt of the order is not a Contract.
The Contract is concluded only upon the Seller’s acceptance of the order (typically via shipping confirmation/hand‑over to the carrier).
In case of an obvious pricing/description error or manufacturer unavailability, the Seller may refuse/cancel the order and refund the payment. Goods are typically supplied “made to order” only after availability is confirmed and after full payment is received.
If the order concerns a gift voucher, it is delivered electronically (the code is sent to the Buyer’s e‑mail) after payment is received.
5. Customer account and communication
The E‑shop may allow account registration. The Buyer is responsible for the accuracy of the information provided and for keeping access credentials secure. The Seller is not liable for misuse of the account by third parties. Notices may be delivered electronically (by e‑mail).
6. Payments
Payments are processed via Shopify Payments: payment cards, Apple Pay, Google Pay and bank transfer (as available in the checkout).
7. Gift vouchers
A gift voucher is an electronic code with a nominal value that can be used as a discount against the purchase price in the online shop www.luxuryhumidors.eu. The voucher cannot be exchanged for cash and no cash refunds can be made from it.
The voucher is valid for 12 months from the date of purchase. After expiry, the voucher becomes invalid and cannot be used.
The voucher is redeemed by entering the code in the cart. The voucher value is deducted from the purchase price. If the order value exceeds the voucher value, the Buyer pays the difference using the selected payment method.
The voucher can be used only once. Any unused balance is forfeited and will not be replaced or paid out. Multiple vouchers may be used for one purchase if the E‑shop system allows it.
Withdrawal – voucher. If the voucher is supplied as digital content (a code) and the Buyer requests immediate delivery, the Buyer acknowledges that the right of withdrawal may be lost after the code has been delivered to the extent the performance has been provided, where permitted by applicable law.
Refunds for Goods paid with a voucher. In the event of withdrawal or an accepted complaint regarding Goods paid wholly or partly by voucher, the corresponding amount will be refunded in the form of a new gift voucher (in the corresponding value), unless mandatory law requires a different refund method.
Code protection and risk of loss. The voucher code must be kept safe. Anyone who uses the code is deemed authorised to redeem it. In case of loss or misuse by a third party, the Seller will not replace or compensate the voucher.
Misuse. The Seller reserves the right to block the voucher in case of reasonable suspicion of fraud, unauthorised acquisition of the code or other misuse.
8. Delivery
All Goods are supplied “made to order”. After availability is confirmed with the manufacturer and after full payment is received, delivery is typically within 30 days. Shipping within the EU is typically free of charge (unless stated otherwise in the cart). Carrier: typically Česká pošta; the Seller may choose another carrier depending on the shipment and delivery country. The risk of loss/damage passes to the Buyer only upon physical receipt of the Goods. Failure to accept delivery without a valid reason: the Seller may claim reimbursement of reasonably incurred actual costs (outbound/return shipping, packaging) and, after notice, a reasonable storage fee.
9. Withdrawal (14 days)
The Buyer may withdraw within 14 days from receipt of the Goods. An e‑mail to info@luxuryhumidors.eu stating the order number and an unequivocal withdrawal statement is sufficient. The Goods must be returned within 14 days of withdrawal to: Cigars s.r.o., Sadová 535, Dobšice, 671 82, Czech Republic.
Return shipping costs are borne by the Buyer.
The Buyer is liable only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
The Seller recommends returning the Goods unused, undamaged and, if possible, in the original packaging. Refunds: no later than 14 days; the Seller may withhold the refund until the Goods are received or until dispatch is proven.
If the order was paid wholly or partly by gift voucher, the Seller will refund the corresponding amount primarily by issuing a new gift voucher; the remaining part (if paid otherwise) will be refunded using the same payment method used for payment.
10. Complaints (non‑conformity / statutory rights)
How to claim. Please submit complaints by e‑mail to info@luxuryhumidors.eu and include the order number, a description of the defect and ideally photos. Depending on the nature of the defect, the Seller may request that the Goods be sent to the complaints address stated in these Terms.
Duration. The Buyer has statutory rights in particular if a defect appears within 24 months of taking delivery, unless the law of the Buyer’s country of habitual residence provides a longer period.
Presumption. If a defect appears within the first 12 months, it is presumed that the Goods were defective at the time of delivery unless the nature of the Goods or the defect is incompatible with that presumption or the Seller proves otherwise. Some countries may provide a longer presumption period.
Remedies. The Buyer may request repair or replacement. If repair or replacement is impossible, disproportionate or not provided within a reasonable time, the Buyer may request an appropriate price reduction or withdraw from the Contract (especially for a major defect or repeated occurrence).
Costs. If the complaint is accepted as justified, the Seller bears reasonably incurred costs; otherwise, the Buyer bears the costs.
If the Goods were paid by gift voucher, performance in an accepted complaint will be handled similarly as in withdrawal – by issuing a new voucher in the corresponding value, unless agreed otherwise or required by mandatory law.
Processing time (CZ). If the Buyer is a consumer in the Czech Republic, the complaint will be handled without undue delay, no later than 30 days from submission unless a longer period is agreed.
11. Manufacturer’s lifetime warranty for the humidor body
A lifetime warranty for the humidor body is provided by the manufacturer as a commercial (voluntary) warranty. The Seller provides assistance with communication and administration (contact point) unless the manufacturer specifies a different procedure. The manufacturer’s commercial warranty does not limit the Buyer’s statutory rights.
12. Personal data, cookies
Processing of personal data is governed by the Privacy Policy (GDPR) and the cookie banner settings in the E‑shop.
13. Out‑of‑court dispute resolution (ADR)
The Seller first seeks to resolve disputes amicably after direct contact with the Buyer (by e‑mail).
If a dispute cannot be resolved by agreement, the Buyer may contact the competent consumer ADR body in the country of their habitual residence.
For Buyers in the Czech Republic, the competent body is the Czech Trade Inspection Authority (ČOI); contact details are provided in Annex A.
14. Final provisions
Choice of law: The Contract is governed by the law of the Czech Republic; however, mandatory consumer protections under the law of the Buyer’s habitual residence within the EU are not affected.
The annexes below supplement these Terms. They are not “different” purchase conditions – they only explain mandatory information or provide templates.
Annex A – Czech Republic (CZ): applies if the delivery address is in CZ (and/or you purchase as a consumer from CZ).
Annex B – selected EU countries (DE/AT/FR): applies if delivery is to these countries or if you purchase from them; it mainly contains mandatory information links (e.g., Impressum).
Annex C – Model withdrawal form: may be used for withdrawal within 14 days; it is not mandatory – an e‑mail is sufficient.
ANNEX A – Czech Republic (CZ)
This annex supplements information required under Czech law (especially regarding ADR) and clarifies certain local obligations for Czech consumers.

Currency: For consumers in CZ, prices must be stated in CZK (in addition to any indicative EUR price).
ANNEX B – Information blocks for selected EU countries
This annex contains brief information blocks that certain EU countries require in addition (typically mandatory links such as “Impressum/Offenlegung” or mediation information).
The core purchase rules are the same across the EU; this annex only supplements them.
EU‑wide (checkout): In the last step of the order, it must be clearly stated that submitting the order creates an obligation to pay (e.g., “Order with obligation to pay”).

France (FR) – mediation: In France, some sellers provide information about mediation for consumer disputes. Currently, the Seller does not appoint a mediator; we first try to resolve everything directly with the customer. In case of a complaint, please contact us first at info@luxuryhumidors.eu so we can try to resolve the matter amicably.
ANNEX C – Model withdrawal form (Czech language)
This is a model form that may be used to withdraw from the contract within 14 days. It is not mandatory – you can also withdraw by a simple e‑mail, provided you clearly state that you withdraw and include the order number.
